These Terms and Conditions set out the basis on which we provide waste clearance and related services in Kingston upon Thames and surrounding areas. By making a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before arranging any waste collection or clearance service.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 "Company", "we", "us" and "our" refer to the waste clearance service provider operating these terms.
1.2 "Customer", "you" and "your" refer to the person, business or organisation requesting or receiving our services.
1.3 "Services" means any waste collection, rubbish removal, bulky waste clearance, house clearance, garden waste removal, commercial waste collection or related services supplied by us.
1.4 "Site" means the property, premises, land or location where the Services are to be carried out.
1.5 "Waste" means any items, materials, rubbish or refuse that you ask us to remove, and that we agree to collect, subject to applicable law and these terms.
2.1 We provide waste clearance and rubbish removal services on a one-off or scheduled basis, covering domestic and commercial premises within our service area, including Kingston upon Thames.
2.2 Our Services may include the loading, removal, transportation and lawful disposal or recovery of non-hazardous waste, subject to any restrictions stated in these Terms and Conditions or communicated during booking.
2.3 We reserve the right to refuse to collect any Waste that, in our reasonable opinion, is hazardous, unsafe, prohibited by law, incorrectly presented, contaminated, or exceeds agreed volumes or weights.
3.1 You can request a booking by telephone, email or through any booking system we make available. All bookings are subject to our acceptance and availability.
3.2 When making a booking, you must provide accurate information, including:
(a) your full name and contact details;
(b) the address of the Site and any access instructions;
(c) the type, approximate volume and nature of Waste to be collected;
(d) preferred date and time window for collection.
3.3 Any quote given prior to arrival is based on the information you provide and is an estimate only. The final price may be confirmed or adjusted once our team has inspected the Waste at the Site.
3.4 A booking is only confirmed when we have provided written or verbal confirmation and, where required, when any deposit or prepayment has been received.
3.5 You must ensure that a person aged 18 or over is present at the Site at the agreed time to grant access and, where necessary, to confirm the Waste to be removed.
4.1 You are responsible for ensuring safe, reasonable and lawful access to the Site for our staff and vehicles, including any necessary parking arrangements or permits.
4.2 If parking permits, visitor passes, meter payments or special access arrangements are required, you must arrange these in advance or reimburse us for any reasonable costs incurred.
4.3 You must ensure that the Waste is clearly identified and, unless otherwise agreed, is reasonably accessible and ready for collection at the time of our visit.
4.4 We are not responsible for any delay or inability to complete the Services arising from blocked access, unsafe conditions, incorrect address details, or your failure to provide access. In such cases, we may charge a call-out or wasted journey fee.
5.1 We operate in accordance with applicable UK waste regulations, including the duty of care relating to the handling, transfer and disposal of controlled waste.
5.2 Unless expressly agreed in writing, our Services do not include the removal of the following types of waste:
(a) hazardous or special waste (including asbestos, chemicals, solvents, oils, paint, medical waste, clinical waste, pesticides, gas cylinders, and similar materials);
(b) liquids of any kind;
(c) explosives, firearms or ammunition;
(d) pressurised containers or tanks;
(e) any item or material that is illegal to possess, transport or dispose of.
5.3 If we discover any prohibited or hazardous items within the Waste, we may refuse to remove them, adjust our charges to reflect additional handling requirements, or suspend the Service until a safe solution is agreed.
5.4 You are responsible for informing us in advance if any Waste may contain sharp, fragile, heavy, or awkward items so that we can assess safe handling measures.
6.1 Our charges are generally based on the volume and weight of Waste, the type of materials, the labour required, and any additional services (such as dismantling, packing, or extra loading time).
6.2 Any quotation given before our arrival is an estimate only. The final price will be confirmed once our team has inspected the Waste on Site and agreed the scope of work with you.
6.3 If you decide not to proceed with the collection after we arrive and provide a final price, we reserve the right to charge a reasonable call-out or attendance fee to cover our costs.
6.4 All prices are given in pounds sterling and may be subject to VAT or other applicable taxes, which will be clearly indicated where charged.
7.1 Unless we agree otherwise in writing, payment is due in full on completion of the Service, and before our team leaves the Site.
7.2 We may accept payment by cash, debit or credit card, bank transfer, or other methods as notified from time to time. We do not accept cheques unless expressly agreed in advance.
7.3 For business or account customers, we may agree invoicing terms, in which case payment is due within the agreed credit period. We reserve the right to withdraw credit facilities at any time.
7.4 If you do not pay any amount due on time, we may charge interest on overdue sums at the statutory rate and recover any reasonable costs incurred in pursuing payment.
8.1 You may cancel or amend a booking by contacting us as soon as possible.
8.2 If you cancel more than 24 hours before the scheduled appointment time, no cancellation fee will normally apply, unless we have incurred specific non-refundable costs on your behalf.
8.3 If you cancel less than 24 hours before the scheduled appointment time, or fail to provide access when we attend, we reserve the right to charge a reasonable cancellation or wasted journey fee.
8.4 If you wish to increase the amount of Waste or change the scope of work on the day, we will do our best to accommodate this, subject to time, vehicle capacity and safety considerations. Any additional charges will be confirmed before proceeding.
8.5 We may cancel or reschedule a booking due to circumstances beyond our reasonable control, including severe weather, traffic incidents, vehicle breakdown, staff illness, or changes in law or regulation affecting the Service. In such cases, we will aim to provide as much notice as reasonably possible and offer a new appointment.
9.1 We will carry out the Services with reasonable care and skill and in compliance with applicable laws and waste regulations.
9.2 Our team will load the Waste into our vehicle, remove it from the Site, and arrange for lawful disposal, recycling, or recovery at licensed facilities.
9.3 We may take photographs of the Waste and the Site before and after the collection, for the purposes of record-keeping, compliance and handling any queries or disputes.
9.4 We are not obliged to sweep, clean, or tidy areas after Waste removal, but may do so at our discretion. Any such activity does not extend our liability for the condition of the Site.
10.1 You confirm that you either own the Waste or have full authority from the owner to arrange for its removal and disposal. You indemnify us against any claim from a third party alleging that the Waste did not belong to you or was removed without proper consent.
10.2 You must ensure that the Site is reasonably safe for our staff to access and work within, and you must notify us of any known hazards, risks or structural issues that could affect the Service.
10.3 You must not ask our staff to undertake any activity that falls outside the agreed Services or that may breach health and safety standards or applicable law.
11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot lawfully be excluded.
11.2 Subject to clause 11.1, our total liability to you arising out of or in connection with the Services, whether in contract, tort (including negligence) or otherwise, shall not exceed the total amount paid or payable by you for the specific Service giving rise to the claim.
11.3 We will take reasonable care when carrying out the Services. However, we are not liable for:
(a) pre-existing damage, wear and tear, or defects at the Site or in any items remaining at the Site;
(b) loss or damage arising from inaccurate or incomplete information provided by you;
(c) any indirect, special or consequential loss, including loss of profit, business interruption, loss of data, loss of goodwill, or loss of opportunity.
11.4 You should remove or adequately protect any fragile, valuable or sentimental items before our arrival. We are not responsible for such items unless you have specifically notified us of them and we have expressly accepted responsibility in writing.
11.5 We are not responsible for any failure or delay in performing the Services caused by events beyond our reasonable control, such as severe weather, traffic disruption, strikes, accidents, or changes in law. In such circumstances, our obligations are suspended for the duration of the event.
12.1 We operate under relevant UK waste legislation and hold any required registrations or licences to carry and manage controlled waste.
12.2 Where required by law, we will complete a waste transfer note or other documentation for the transfer of Waste from you to us or to our authorised partners.
12.3 By engaging our Services, you acknowledge and accept that the Waste will be transported to licensed facilities for recycling, recovery, or disposal in accordance with applicable regulations and our environmental policies.
13.1 We may collect and process personal information about you in order to manage bookings, provide the Services, process payments, and handle queries or complaints.
13.2 We will handle your personal data in compliance with applicable data protection laws. Your information will be kept secure and will only be shared where necessary to deliver the Services, comply with legal obligations, or pursue legitimate business interests such as debt recovery.
14.1 If you are dissatisfied with any aspect of our Services, you should contact us promptly with details of the issue so that we can investigate and, where appropriate, attempt to resolve it.
14.2 We may request supporting information, including photographs, invoices or proof of payment, to assist in handling your complaint.
14.3 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with the Services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to you.
15.2 The Terms and Conditions that apply to your booking will normally be those in force on the date your booking is confirmed, unless a change is required by law or regulation.
16.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
16.2 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent.
16.3 No failure or delay by us in exercising any right or remedy shall constitute a waiver of that or any other right or remedy.
16.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the Services and supersede any previous agreements or understandings, whether written or oral.
